In Sept 2016, the Federal Court, Justice, Russell Zinn found that a workplace investigator failed to retain an open mind during the investigation. In Balraj Shoan and Attorney General of Canada (2016 FC 1003), Justice Zinn’s findings reinforce the need for internal and external investigators, to be experienced, stay neutral, unbiased, and impartial.
